China’s “first to file” patent policy has further exacerbated this issue, catching many companies off guard when they discover their products have been copied and are being sold in China.

It is a common misconception that filing a patent application in one’s home region automatically extends protection to China. While there is some truth to this belief, it only offers temporary coverage for a brief period in China once the patent is filed and approved in the home region.
